TecGigs.com connects technical providers with those individuals or companies seeking resources for technical jobs or “Gigs”. For purposes of this Agreement we will use the terms “Gigs” for jobs, “Providers” for technical providers, “Employers” for those users posting Gigs, “Listings” for Provider Directory Listings, “Subscribers” for those paying for full access to Gig details, and “Users” for anyone accessing the site in any capacity.
This Terms of Use Agreement sets forth the terms and conditions which govern your use of the TecGigs website (“Site”) and/or the services provided thereon. By accessing the Site, you agree to be bound by this Agreement. This Agreement is subject to change and all changes are effective when they are posted on the Site. Your continued use of the Site after any changes are posted constitutes your acceptance of any changes to the Terms of Use Agreement.
The Site provides a Directory for Providers to provide information about their Company and or Services which they offer. Providers do this by posting listings in the TecProvider directory (the “Directory”). The Site furthermore provides the ability for the posting of Gigs by Employers. Subscribers (who may or may not be Providers) can register and pay for a monthly or annual recurring Subscription which will allow full access to Gig details.
Provider Directory Listings and Gig Postings
It is the responsibility of Providers and Employers to provide accurate information. TecGigs is not responsible for any claims or disputes related to any incomplete or inaccurate information provided by you to us. Providers and Employers warrant that they have the right to use and share any content they post on the Site. TecGigs, may, in its sole discretion, terminate the account of any user whom we believe has provided false information to us or any other users or which user has posted prohibited content as listed below.
TecGigs reserves the right to delete any posted content that, in the sole discretion of TecGigs, violates this Terms of Use Agreement. Prohibited content includes but is not limited to that which is:
- abusive, obscene, profane, objectionable, libelous, threatening, harassing
- sexually oriented
- racially offensive
- inaccurate, false, out-of-date or misleading
- any material targeted at individuals under the age of eighteen (18)
- illegal or infringes or violates another user’s rights
- threatens the safety of users
- any copyrighted materials without obtaining the prior written consent of the owner of such rights
- interferes in any way with the Site
- copies any information or content to in order to provide any service that is competitive with TecGigs
- not relevant to the categories of services offered by TecGigs
- recruiting for another website other than connecting with other Users for the purpose of providing or receiving a Gig
User Accounts
To utilize certain services of the site will require the creation of a User account. Users of the Site must be at least eighteen years of age.
During the User account creation process, you will be required to create a password. You are responsible for maintaining the security of your password and any activity occurring on your account. Users agree to not impersonate another user or to allow another entity to use your account in any way. If you suspect any unauthorized use of your account, please notify TecGigs immediately.
Users acknowledge that submission of any content, material, or information in any form is completely voluntary. By using this Site, Users and agree that you have reviewed and agree to our Privacy Policy.
Subscribers
Subscribers are those users who wish to pay for full access to Gigs. The general public can see summary Gig information but only logged in Subscribers can view complete Gig information in addition to being provided the ability to initiate communication with an Employer who has posted the Gig.
Subscriptions information including pricing is available on the Site. Subscriptions are either monthly or annual and are recurring. You may cancel a Subscription at any time; however, you will not be eligible for a refund for any Subscription that is terminated prior to the end of the commitment period. Subscription pricing may be changed at any time in the sole discretion of TecGigs. TecGigs reserves the right to provide complimentary Subscriptions
TecGigs may terminate your Subscription at any time. You will not be entitled to any refunds if we terminate your account due to your breaching the Terms of Use Agreement or any other Policies so posted on the Site. Account termination decisions are in our sole discretion. The Terms of Use Agreement survives termination of a Subscription.
User Interaction and Communication
TecGigs works to create the ability for Users of the site, including Providers, Users, and Subscribers to connect for their business purposes. Users are solely responsible for their interaction with other Users. Employers recognize that TecGigs does not verify Provider information or make any recommendation regarding Provider’s ability to perform work or Provider’s qualifications. TecGigs is not responsible for your reliance on any information or content made available through the Site other than that provided directly by TecGigs. Users expressly agree not to hold TecGigs liable for any damage, suits, claims or controversies whatsoever arising from any relationships developed on the Site.
TecGigs is not involved in any transactions or relationships that occur or develop as a result of connections made through the Site. You expressly agree that TecGigs will not be held liable in any way for any disagreements arising from having made connection via the Site. In the event that you become involved in a dispute with another User, you hereby release TecGigs from all claims, demands, or damages of every kind, whether known or unknown, in any way related to the dispute.
You further agree to indemnify, defend, and hold harmless TecGigs from and against all claims, loss, expense or demand of liability (including attorneys’ fees) and costs incurred by us in connection with any claim by a third party arising out of your failure to comply with the Terms of Use Agreement, your submission of content on the Site or any activity in which you engage through the Site. You also agree to cooperate in the defense of any such claims.
Copyrights
TecGigs has a procedure for receiving written notice of claimed copyright infringement. If you believe your copyrights are being infringed ay a User of the Site please provide for us the following information:
- Identification of the copyrighted work which is claimed to have been infringed.
- Identification of the material that is claimed to be infringing and that is to be removed and location of the material on the Site.
- A statement that the complaining party has a good faith belief that user of the material on the Site is not authorized by the copyright owner.
- A statement that the information in the notification is accurate and that the complaining party is authorized to act on behalf of the owner of an exclusive right which is allegedly infringed.
- Information sufficient to allow TecGigs to contact the complaining party including a physical address, telephone number, and e-mail address.
- A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

Warranty Disclaimers
You agree not to rely on the Site, any services provided, any information on the site, or its continuation. The services provided by the Site are provided as is and without any warranties or conditions either express or implied including merchantability, accuracy, or fitness for a particular purpose. TecGigs disclaims all warranties and make no representations of warranties of any kind as to the identity, reliability, or quality of any third party or the accuracy of the postings made on the site by any third party.
Limitation of Liability
TecGigs will not, under any circumstances, be liable to you for any special, indirect, consequential, incidental or punitive damages pursuant to this Terms of Use Agreement or your use of the Site and its services including but not limited to, loss of profits, loss of business opportunities, or loss of goodwill, even if you advise us of the possibility of such damages.
This Agreement shall be interpreted under the laws of the State of Alabama, United States of America.
Arbitration & Legal Fees
Any controversy, dispute or claim arising out of, or relating to this Agreement by either party shall be settled by arbitration, in accordance with the rules, then applicable, of the American Arbitration Association, and the parties hereto agree that the decision or award thereby made shall be final and shall be binding on all parties. Arbitration decisions shall be made by a board composed of three members, one chosen by each party hereto and a third chosen by the two previously selected. All meetings and hearings of the Arbitration board shall be held In Jefferson County, Alabama. If any legal action is brought by either party to this Agreement against the other party regarding the subject matter of this Agreement, the prevailing party shall be entitled to recover in addition to any other relief, reasonable attorney's fees and expenses.
General Provisions
Failure by TecGigs to enforce any provisions of this Terms of Use Agreements shall not be construed as a waiver of any provision or right. This Terms of Use Agreement constitutes the entire agreement between you and TecGigs with respect to the Site and any services offered. If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions shall be enforced to the fullest extent possible.
